đ˘ Can a Body Corporate Ban Airbnb?
Under the Unit Titles Act, a Body Corporate does not have the legal power to outright ban short-term letting of units. This was confirmed by the Tenancy Tribunal, which ruled that such a restriction is not âincidental toâ any of the powers granted under the Act. In simple terms, unit owners have the right to lease their unitâwhether short or long termâand Body Corporate rules cannot override this right.

While a Body Corporate cannot prohibit short-term rentals entirely, it can create rules that indirectly limit their viability. These may include:
- Noise control policies
- Restrictions on rubbish disposal or recycling
- Security requirements

These rules must be lawfully adopted at a general meeting of the Body Corporate through an ordinary resolution. Once passed, the rules must be registered with Land Information New Zealand (LINZ) to become enforceable.
