NZ Teacher Reinstated After Suspension: What Employers and Employees Need to Know

In a recent Employment Relations Authority (ERA) decision, a teacher who was suspended during an internal workplace investigation was ordered to be reinstated after the Authority found the suspension was likely unlawful. This case is a powerful reminder of the legal protections available to employees and the obligations placed on employers under New Zealand employment law.

At Core Legal, we often assist both employees and employers in Masterton and Wellington navigating complex issues such as suspension, unjustified disadvantage, and disciplinary investigations.

Background: Principal Suspended During Investigation

The employee in question had served as the principal of a school for 14 years. Following concerns of “disharmony” within school leadership and governance, the Board of Trustees initiated a disciplinary investigation. A Commissioner was later appointed to replace the board, who continued the process.

While the principal was on sabbatical, additional concerns were raised. As a result, the Commissioner suspended her, pending a full investigation. The principal then lodged an application with the ERA for interim reinstatement, arguing the suspension was procedurally flawed and unjustified.

Legal Issues Considered by the Authority

The Authority examined three key questions:

  1. Did the principal have an arguable case of unjustified disadvantage and grounds for permanent reinstatement?
  2. Where did the balance of convenience lie?
  3. Did the overall justice of the case favour interim reinstatement?

Suspension Process Was Arguably Unlawful

The ERA found the Commissioner may have failed to follow the principal’s employment agreement, particularly around suspension procedures. There was little evidence of an inquiry before suspension, and health and safety concerns were not properly addressed as required by law.

This gave rise to an arguable case of unjustified disadvantage and unlawful suspension.

Reinstatement Was Feasible and Justified

The Authority then assessed whether reinstating the principal was practical and appropriate during the ongoing investigation. Since the principal had demonstrated a willingness to cooperate—even in a reduced or limited capacity—and there was no claim of serious misconduct, reinstatement was considered viable.

Furthermore, her long history of service, including efforts to improve her leadership through training, supported the argument that she should be allowed to return to work while the investigation continued.

Damages Were Not Sufficient Compensation

The Authority acknowledged that reputational damage caused by the suspension could not be adequately addressed through financial compensation alone. Therefore, interim reinstatement was determined to be the most just and effective remedy.

Final Outcome

The Employment Relations Authority ordered that the principal be immediately reinstated, lifting the suspension. The decision highlights the importance of fair process and procedural compliance, especially in roles involving public responsibility like school leadership.
