A responsible trustee of a Māori land trust has been removed after repeatedly refusing to complete the necessary documentation to open a bank account for the trust. Despite multiple requests from fellow trustees, the trustee declined each time, citing unresolved issues with the Trust and the whenua (land) as his reason for not acting.

Grounds for Removal

When considering the removal of a trustee, it’s essential to weigh the importance of the Kaupapa (principles) of the Act and the gravity of such an action. Courts are generally reluctant to interfere with private trusts unless justified. However, in this case, the Tribunal found clear grounds for removal.

Without a trust bank account, the trustees could not access funds to operate or distribute to beneficiaries. The trustee’s refusal to comply was seen as a breach of his fiduciary duties, as it prevented the Trust from fulfilling its obligations to its beneficiaries. His argument that unresolved issues with the whenua justified his refusal to sign the bank forms was dismissed by the Tribunal, as there was no direct connection between these issues and the need to open the account.

Breach of Trustee Duties

The Tribunal determined that the trustee’s personal grievances should not have interfered with his professional responsibilities. By obstructing the trust’s financial operations, he failed to uphold the Trust’s purpose of benefiting the beneficiaries and maintaining the land as a taonga tuku iho (treasured inheritance) for future generations.

The Act’s preamble emphasizes the importance of rangatiratanga (self-determination) and the development and utilization of whenua for the benefit of its owners, their whānau, and hapū. The trustee’s inaction was seen as undermining these principles.

Trustee Removal for Proper Trust Execution

The removal of the trustee was deemed necessary to ensure the trust could operate effectively and that the remaining trustees could meet their obligations. This case serves as a reminder that trustees must distinguish between their personal opinions and their fiduciary duties to ensure the trust functions as intended.
