In many subdivisions, access to rear sections is facilitated through right of way easements over adjacent properties. However, conflicts can arise when the underlying landowners or neighbors utilize these easements for various purposes. A recent High Court case delved into the permissible activities on such easements, shedding light on the rights and limitations involved.

The case centered on a 6.2m wide easement with a sealed driveway spanning 3m. While the driveway sufficed for rear section access, the underlying landowner erected retaining walls and pillars within the excess width of the easement. Despite not obstructing the driveway’s use, these additions prompted complaints from neighbors.

An arbitrator, well-versed in easement regulations, ruled that only the sealed driveway needed to remain clear, allowing the new structures to stand. However, aggrieved owners sought leave to appeal this decision, alleging a legal error. The High Court, while considering the leave application, highlighted the importance of keeping entire easement areas unobstructed, even if unused presently, as future access needs may arise.

Recent Land Transfer Regulations reinforce the obligation to keep easement facilities clear at all times, barring any obstructions or unreasonable impediments. This stringent stance allows minimal leeway for interference, except for temporary and minor obstructions.

Ultimately, interference with access rights, beyond momentary parking, can lead to disputes and adverse legal outcomes. Frequent parking, material storage, or debris dumping may provoke neighborly conflicts and legal repercussions. Hence, it’s imperative to understand and adhere to the regulations governing rights of way to avoid disputes and maintain harmonious relationships within communities.
